Register of applications to change public rights of way

​This is register of applications made under Section 53(5) of the Wildlife and Countryside Act 1981.

We have a duty to make available to the public a register of:

  • outstanding applications made under the Wildlife and Countryside Act 1981 to either add, delete, downgrade, upgrade or realign any public rights of way or remove any from the Merton Definitive Map and Statement.
  • declarations of non-intent to dedicate public rights of way under the Highways Act of 1980 made under Section 31(6) of the Highways Act 1980, by landowners, of routes that they acknowledge exist as public rights of way (if appropriate) and a statement of their non-intent to dedicate any other routes that exist across their land.

Definitive records of public rights of way can only be changed by statutory order, in accordance with prescribed legal processes. Orders are made by Merton Council who also have the duty to continuously review and update the Definitive Map and Statement so that it forms an accurate record of the public right of way network.
