Following decisions by the council's Cabinet on 9 December 2013, all four required legal processes to allow the expansion of Dundonald Primary School from September 2015 have now been agreed. The details of the various consultations and legal processes are detailed below.
The council hopes to commence construction shortly to implement these decisions but there have been delays due to Judicial Review challenges. Dundonald Primary School expansion - statutory notice under Education Law
Following the consultation, on 31 October 2013 the council published a notice under section 19(1) of the Education and Inspections Act 2006 to permanently expand Dundonald Primary School from 210 to 420 places. Dundonald Recreation Ground and Primary School Land appropriation
On 3 October 2013 the council published a notice under section 122 of the Local Government Act of its intentions to appropriate for the purposes of the enlargement of the Dundonald Primary School, and for additional facilities for the sole or shared benefit of that school, an area of land forming part of the Dundonald Recreation Ground, which includes land used as open space.

The Upper Tribunal (Lands Chamber) has agreed LB Merton's application to modify the restrictive covenant for a small area of Dundonald Rec to allow the expansion of Dundonald Primary School.

On 17 January 2013 the LB Merton Planning Applications Committee approved the application to expand Dundonald Primary School with linked works to the recreation ground. The Greater London Authority and the Secretary of State have both agreed they do not wish to intervene with this decision. Following the public consultation in Summer 2011 Merton Council's Cabinet decided in September 2011 to proceed to the next stage of expanding Dundonald School.
